These Fishery Participation Terms govern the participation of fisheries, angling clubs, estates, syndicates, trusts, associations, and other organisations offering fishing opportunities through the Fishing Around platform.
By creating a listing, accessing the fishery dashboard, accepting bookings, receiving payments, or continuing to use the platform, you agree to be bound by these Fishery Participation Terms.
If you do not agree to these Terms, you must cease using the platform and request removal of your listing.
Platform Provider
The Fishing Around platform is provided as part of the activities of Fishing Around the UK CIC.
The platform is operated on behalf of Fishing Around the UK CIC by Fishing Around Ltd, which provides technical, operational, payment processing, and support services.
Fishing Around the UK CIC retains overall governance and oversight of the platform.
Nature of the Platform
Fishing Around operates as a digital marketplace connecting anglers with participating fisheries.
The platform facilitates transactions between anglers and fisheries.
Fishing Around does not own or sell fishing permits.
The participating fishery remains the seller of all permits offered through the platform.
The fishery is responsible for the fishing experience provided, including access, safety, fishery rules, availability, and compliance with applicable laws and regulations.
Fishing Around acts as an intermediary and platform provider. It does not operate the fishery, control fishery conditions, or guarantee the quality, availability, or success of any fishing experience.
Eligibility to Participate
To participate, a fishery must:

have authority to offer fishing permits or access rights
-
provide accurate ownership, management, or operational details where requested
-
comply with applicable laws, permissions, regulations, and byelaws
-
maintain accurate listing information
-
provide accurate permit, pricing, access, and rule information
-
act in good faith when using the platform
Fishing Around may request reasonable evidence of authority, ownership, management status, identity, insurance, or other relevant information before approving or maintaining a fishery listing.
Fishing Around may refuse, suspend, restrict, or remove participation where it reasonably considers that the fishery does not meet the platform’s participation requirements.
Fishery Responsibilities
The fishery retains full responsibility for:

permit pricing
-
availability of fishing days, rods, or access
-
fishery rules and conditions
-
legal fishing methods and restrictions
-
access arrangements
-
local safety matters
-
parking, entry points, boundaries, and maps
-
catch return requirements
-
compliance with legal and regulatory requirements
-
the accuracy of all fishery information supplied to the platform
The fishery agrees to:
-
keep listings accurate and up to date
-
honour valid permits issued through the platform
-
communicate material changes affecting bookings promptly
-
deal reasonably with anglers using the platform
-
support responsible angling and lawful access
-
notify Fishing Around promptly of any change that may affect the accuracy of its listing or the availability of permits
-
ensure that all rules supplied to the platform are lawful, clear, and capable of being followed by anglers
Active Permit Requirement
To remain publicly visible and available for booking on the platform, each participating fishery must maintain at least one active permit offering, unless otherwise agreed by Fishing Around.
An active permit offering means a permit, ticket, membership, day rod, season rod, syndicate place, or other fishing access product that is available through the platform and capable of being booked, purchased, requested, or otherwise accessed by anglers.
Where a fishery does not have any active permit offering, The Fishing Around platform recognises that the fishery details are incomplete and may disable, hide, unpublish, restrict, or otherwise remove the fishery from public-facing areas of the platform until an active permit offering has been created, approved, and made available.
This may include removal from:
-
fishery listings
-
search results
-
maps
-
booking pages
-
promotional areas
-
featured fishery sections
-
newsletters
-
social media promotions
-
other public-facing areas of the platform
A fishery may be re-enabled once it has at least one active permit offering that meets the platform’s listing, pricing, availability, and compliance requirements.
Fishing Around may make exceptions where a fishery is being shown for conservation, information, seasonal, educational, access, or partnership purposes, but this is at Fishing Around’s discretion.
Listings, Images and Content
The fishery may provide content for use on the platform, including:

descriptions
-
images
-
videos
-
maps
-
logos
-
permit information
-
fishery rules
-
notices
-
catch return instructions
-
access information
-
safety information
-
seasonal updates
-
promotional information
The fishery confirms that it owns, controls, or has permission to use any content supplied to the platform.
By providing content to the platform, the fishery grants Fishing Around the UK CIC and Fishing Around Ltd a non-exclusive, royalty-free licence to use, reproduce, edit, crop, format, publish, display, and distribute that content for the purposes of:

operating the platform
-
creating and maintaining fishery listings
-
promoting the fishery
-
promoting the Fishing Around platform
-
marketing fishing opportunities available through the platform
-
producing website, email, social media, advertising, and printed promotional materials
-
supporting conservation, access, education, and responsible angling communications
This licence applies to content supplied directly by the fishery or supplied on its behalf.
The fishery confirms that, where content includes photographs or videos of identifiable individuals, it has obtained any permissions or consents required for that content to be used for the purposes described in these Terms.
Fishing Around may amend formatting, spelling, layout, cropping, image sizing, or presentation for consistency, provided the meaning of the content is not materially changed.
Fishing Around will not sell fishery-supplied images or content as standalone media assets.
Fishing Around may continue to use content in existing promotional materials, historic posts, archived materials, or previously published campaigns after a fishery listing is removed, unless removal is reasonably requested and practicable.
Fishing Around may remove inaccurate, misleading, unlawful, offensive, unsuitable, outdated, or low-quality content at its discretion.
External Links and Off-Platform Bookings
Fishing Around is intended to provide a direct booking and access platform for participating fisheries.
Unless expressly agreed by Fishing Around, fishery listings must not include links, instructions, or calls to action that direct anglers away from the platform to complete bookings, purchase permits, join waiting lists, make payments, or access alternative booking systems.
Fishing Around may remove or amend links, text, images, buttons, documents, or other content that it considers likely to divert users away from the platform or undermine the platform’s booking process.
This does not prevent the inclusion of appropriate supporting information, such as fishery websites, club background information, conservation information, or access guidance, where approved by Fishing Around and where it does not conflict with the purpose of the platform.
Bookings and Permits
When an angler purchases a permit:

a booking confirmation is issued digitally
-
the permit is treated as valid unless cancelled or suspended in accordance with applicable terms
-
the fishery must recognise valid permits issued through the platform
-
the angler must comply with the fishery rules and permit conditions shown at the time of booking
Permits may include:
-
digital confirmation
-
QR code or verification reference
-
booking reference
-
permit status
-
profile image or identification features where enabled
-
date, time, beat, location, or access details
-
fishery rules and restrictions
The fishery must not refuse a valid permit issued through the platform unless there is a legitimate reason, such as suspected misuse, safety risk, breach of fishery rules, legal restriction, or cancellation confirmed by the platform or fishery.
Where a fishery needs to cancel, restrict, or amend an existing booking, it must notify Fishing Around and affected anglers as soon as reasonably practicable.
Platform Fees
Fishing Around charges service fees for facilitating bookings and operating the platform.
These may include:

a booking fee charged to anglers
-
a platform service fee charged to the fishery
-
payment processing or administration fees
-
agreed subscription, access, or support fees
Applicable fees may be displayed on the platform, agreed separately, or updated from time to time.
Continued use of the platform after notification of revised fees constitutes acceptance of the updated fees.
Platform fees support the operation, maintenance, development, security, marketing, support, payment handling, and administration of the platform.
Payments and Payouts
Payments are processed through secure third-party payment systems operated by Fishing Around Ltd.
The fishery appoints Fishing Around Ltd as collection agent for permit payments made through the platform.
Accordingly:

permit revenue is collected on behalf of the fishery
-
platform fees may be deducted
-
payment processing charges may be deducted where applicable
-
remaining funds are distributed to the fishery
The fishery must maintain accurate payout details.
Payments are subject to standard settlement periods, verification procedures, fraud controls, payment provider requirements, and any applicable deductions.
Fishing Around may delay or withhold payouts where reasonably necessary to investigate suspected fraud, chargebacks, disputes, inaccurate information, breach of these Terms, legal obligations, or payment provider requirements.
The fishery is responsible for any tax, accounting, reporting, or financial obligations arising from income received through the platform.
Refunds, Account Credit and Rescheduling
Bookings made through the platform are subject to the angler Terms and Conditions.
Refunds, account credit, rescheduling, and booking changes may be administered by the platform on behalf of the fishery.
Unless otherwise stated:

account credit may be requested within 7 days of the original transaction date, provided the request is also made at least 7 days before the scheduled fishing date
-
both conditions must be met for account credit to be available
-
approved account credit expires 12 months after the date of issue
-
cash refunds are not available except where required by law or where determined by the platform
-
bookings may be rescheduled once only, up to 7 days before the scheduled fishing date, subject to availability
-
no refund, account credit, or rescheduling will be available within 7 days of the scheduled fishing date unless the booking is cancelled by the fishery, cancelled by the platform, or required by law
-
platform service fees are non-refundable once a booking is completed, except where required by law or where the booking is cancelled by the fishery or the platform
The fishery agrees to cooperate reasonably in resolving legitimate booking issues.
Where a booking is cancelled by the fishery, the fishery may be responsible for any refund, account credit, rescheduling arrangement, or associated adjustment required by the platform.
Fishing Around may make reasonable decisions on refund, credit, cancellation, and rescheduling matters to protect anglers, fisheries, the platform, and legal compliance.
Catch Returns and Fishery Reporting
Where catch returns are enabled or required for a fishery, the fishery agrees to provide accurate catch return requirements and cooperate with the platform in collecting, managing, and reporting catch information.
Catch return requirements may include:

species caught
-
numbers caught and released
-
numbers retained where lawful
-
fishing effort
-
dates fished
-
beat or location
-
method used
-
other information reasonably required for fishery management or statutory reporting
The fishery is responsible for ensuring that any catch return requirements it asks the platform to collect are lawful, proportionate, and relevant.
Fishing Around may use aggregated or anonymised catch, effort, booking, and participation data to support fishery management, reporting, conservation, funding, research, and platform development.
Data Protection and Data Sharing
Fishing Around the UK CIC acts as Data Controller for personal data processed through the platform.
Fishing Around Ltd, and appointed developers, technology partners, contractors, or service providers where applicable, may act as Data Processors on behalf of the CIC under appropriate contractual arrangements.
The fishery may receive or access limited personal data relating to anglers where necessary for legitimate platform participation, booking fulfilment, fishery management, customer service, compliance, or enforcement purposes.
Such data may include:

contact details
-
permit details
-
booking dates
-
permit status
-
profile image where enabled
-
catch return information where relevant
-
relevant account or booking information
-
incident or compliance information where applicable
The fishery agrees that any personal data received or accessed through the platform shall be:

used only for legitimate fishery-related purposes
-
limited to persons with a genuine operational need to know
-
kept secure and confidential
-
not retained longer than necessary
-
not sold or used for unrelated marketing without lawful basis
-
not disclosed to third parties except where lawful and necessary
-
handled in accordance with applicable data protection law
The fishery acts as an independent Data Controller in respect of personal data it separately controls or receives and is responsible for complying with applicable data protection law.
Fishing Around may share relevant information with fisheries, authorised bailiffs, fishery boards, enforcement bodies, regulators, or other relevant parties where reasonably necessary for:

permit verification

preventing unauthorised fishing
-
enforcing fishery rules
-
investigating misuse or fraud
-
supporting lawful fisheries management
-
responding to incidents
-
complying with legal obligations
-
protecting the platform, anglers, fisheries, or the public
Access to personal data may be logged, monitored, restricted, or withdrawn where appropriate.
Enforcement and Verification Tools
The platform may provide authorised persons with tools for:

permit verification
-
identity confirmation where enabled
-
compliance checks
-
reporting and monitoring
-
investigation of suspected misuse or unlawful fishing
-
checking booking status
-
supporting bailiff or authorised fishery activity
The fishery agrees to support legitimate use of such tools.
The fishery must ensure that any person given access to verification, enforcement, dashboard, or reporting tools uses them lawfully, responsibly, and only for legitimate fishery-related purposes.
Fishing Around may restrict, suspend, or remove access to enforcement or verification tools where misuse, excessive access, inappropriate behaviour, data protection concerns, or other risks are suspected.
Conduct and Reputation
The fishery agrees to use the platform in a professional, lawful, and responsible manner.
The fishery must not use the platform in a way that:

misleads anglers
-
damages the reputation of Fishing Around
-
undermines trust in the platform
-
encourages unlawful fishing or access
-
discriminates unlawfully
-
misuses personal data
-
interferes with platform operation
-
bypasses platform payment or booking processes
-
creates avoidable risk to anglers, fisheries, or the public
Fishing Around may take reasonable action where fishery conduct presents a legal, reputational, operational, financial, or safeguarding concern.
Suspension, Restriction or Removal
Fishing Around may suspend, restrict, disable, hide, unpublish, or remove a listing or fishery account immediately where reasonably necessary, including for:

breach of these Terms
-
misuse of the platform
-
suspected fraud
-
reputational or legal risk
-
inaccurate or misleading listings
-
failure to pay agreed fees
-
misuse of personal data
-
lack of authority to offer fishing access
-
failure to honour valid permits
-
repeated complaints or unresolved booking issues
-
unsafe, unlawful, or unsuitable access arrangements
-
directing users away from the platform to complete bookings or payments
-
failure to maintain at least one active permit offering
-
any other matter that Fishing Around reasonably considers may harm anglers, fisheries, the platform, or public trust
Where appropriate, notice may be given.
Fishing Around is not required to maintain a public listing for any fishery that does not have an active permit offering available through the platform.
Where a fishery listing is suspended, restricted, hidden, or removed, existing bookings may still need to be honoured unless otherwise agreed or lawfully cancelled.
Liability
Fishing Around acts solely as a facilitator of transactions between anglers and fisheries.
To the fullest extent permitted by law, Fishing Around shall not be liable for:

fishing conditions
-
weather or environmental factors
-
water levels
-
fish stocks or catch success
-
fishery management decisions
-
access issues outside platform control
-
acts or omissions of fisheries or anglers
-
incorrect information supplied by the fishery
-
local hazards, risks, or safety issues
-
loss arising from a fishery’s failure to comply with these Terms
-
disputes between anglers and fisheries, except to the extent the platform chooses to assist
The fishery remains solely responsible for:
-
delivery of fishing services
-
condition and safety of waters or premises
-
compliance with law
-
local operational decisions
-
rules, access, and permit conditions
-
information supplied to anglers through the platform
Nothing in these Terms limits or excludes liability where it would be unlawful to do so.
Indemnity
The fishery agrees to indemnify Fishing Around the UK CIC and Fishing Around Ltd against reasonable losses, claims, costs, liabilities, or expenses arising from:

inaccurate information supplied by the fishery
-
lack of authority to offer permits or access
-
breach of these Terms
-
unlawful or unsafe fishery operations
-
misuse of personal data by the fishery or its authorised users
-
failure to honour valid permits
-
disputes caused by fishery error, omission, or misconduct
-
infringement of third-party rights in content supplied by the fishery
This clause applies only to the extent that the relevant loss, claim, cost, liability, or expense arises from the act, omission, breach, or responsibility of the fishery.
Changes to These Terms
Fishing Around may amend these Terms from time to time.
Updated versions may be published on the platform or otherwise notified.
By continuing to use the platform after updated Terms take effect, the fishery agrees to be bound by the updated Fishery Participation Terms.
Where a material change is made, Fishing Around may provide notice where reasonably practicable.
Ending Participation
A fishery may cease using the platform at any time by requesting removal of its listings and settling any outstanding obligations.
Existing bookings may still need to be honoured unless otherwise agreed or lawfully cancelled.
Ending participation does not affect:

outstanding payments or fees
-
existing bookings
-
refund, credit, or rescheduling matters
-
data protection obligations
-
content already used in published or historic materials
-
any rights or obligations that should reasonably continue after participation ends
Fishing Around may retain records where necessary for legal, accounting, reporting, dispute resolution, fraud prevention, or platform administration purposes.
Governing Law
These Terms are governed by the laws of Scotland.
The Scottish courts shall have jurisdiction, except where applicable law provides otherwise.
