These Terms and Conditions govern the use of the Fishing Around platform and apply to all users who access or make bookings through the platform.

By using the platform, creating an account, or completing a booking, you agree to be bound by these Terms.

Platform Overview

The Fishing Around platform is provided as part of the activities of Fishing Around the UK CIC.

Fishing Around exists to support access to angling, fisheries management, and conservation outcomes.

The platform connects anglers with fisheries offering fishing permits.

Platform Operation

The platform is operated on behalf of Fishing Around the UK CIC by Fishing Around Ltd, which provides technical, operational, and payment processing services.

Fishing Around Ltd supports the operation of the platform and facilitates transactions between anglers and fisheries.

Fishing Around the UK CIC retains overall governance and oversight of the platform.

Nature of the Platform

Fishing Around operates as a digital marketplace enabling anglers to purchase fishing permits directly from participating fisheries.

Fishing Around facilitates transactions between anglers and fisheries.

Fishing Around does not own or sell fishing permits.

Each permit purchased through the platform is sold by the participating fishery. The platform acts solely as an intermediary facilitating the transaction between the angler and the fishery.

The fishery is the seller of the fishing permit and is responsible for the provision of the fishing experience, including access, availability, safety, fishery rules, and compliance with applicable laws and regulations.

Eligibility

Users must be at least 18 years of age to create an account and purchase permits.

Users agree to provide accurate and complete information when using the platform.

User Accounts

Some platform features may require users to create an account.

Users are responsible for maintaining the confidentiality of their account credentials.

The platform may suspend or terminate accounts where misuse, suspected fraud, or breach of these Terms is suspected.

Permit Purchases

Fishing permits listed on the platform are offered by participating fisheries.

Fisheries determine:

  • permit prices

  • availability

  • fishing rules

  • access arrangements

When purchasing a permit, anglers agree to comply with the rules and conditions set by the relevant fishery.

By completing a booking, the angler confirms that they have reviewed and accepted:

  • these Terms and Conditions

  • the specific fishery rules and permit details shown at the time of booking

Platform Fees

The platform charges service fees to facilitate bookings.

Fees may include:

  • an angler booking fee added to the permit price

  • service fees charged to fisheries

Platform service fees are clearly displayed during the booking process prior to payment.

Platform service fees are non-refundable once a booking is completed, except where required by law or where the booking is cancelled by the fishery or the platform.

Payment Processing

Payments are processed through secure third-party payment providers operated by Fishing Around Ltd.

The platform does not store payment card details.

When a booking is made, the total amount, including any platform fees, is collected through the platform payment system on behalf of the participating fishery.

Fishing Around Ltd acts as payment collection agent for participating fisheries.

Platform fees are retained by Fishing Around Ltd, and the remaining permit revenue is distributed to the fishery in accordance with the platform payment process.

Upon successful payment, a permit confirmation will be issued to the user.

Fishery Rules

Each fishery may have its own rules relating to:

  • fishing methods

  • catch and release requirements

  • seasonal restrictions

  • safety guidelines

  • access arrangements

Anglers must comply with all fishery rules.

Failure to comply may result in removal from the fishery without refund, account credit, or rescheduling.

Conservation and Responsible Angling

Fishing Around promotes responsible angling practices and the sustainable management of fisheries.

Anglers are expected to follow conservation guidelines where applicable.

Permit Validity

Permits are valid only for the date, location, and permit type specified at the time of booking.

Permits may not be resold or transferred unless expressly permitted by the fishery.

Refunds, Credits and Rescheduling

All bookings made through the platform are final and subject only to the conditions set out in this section.

All payments relate to permits sold by the participating fishery. The platform administers refund eligibility, account credit, and rescheduling on behalf of the participating fishery in accordance with these Terms.

Refunds are not provided in cash or returned to the original payment method, except where required by law or where determined by the platform.

Where eligible, refunds are issued as account credit only.

Account credit may be requested within 7 days of the original transaction date, provided the request is also made at least 7 days before the scheduled fishing date.

Both conditions must be met for account credit to be available.

Account credit expires 12 months after the date of issue.

Bookings may be rescheduled once only, up to 7 days before the scheduled fishing date, subject to availability.

Rescheduling is not permitted within 7 days of the scheduled fishing date.

No refund, account credit, or rescheduling will be available within 7 days of the scheduled fishing date unless the booking is cancelled by the fishery, cancelled by the platform, or required by law.

Platform service fees are non-refundable once a booking is completed, except where required by law or where the booking is cancelled by the fishery or the platform.

This refund, account credit, and rescheduling policy is a discretionary policy provided by the platform and does not represent a statutory cancellation right.

The refund and cancellation terms for each permit are set by the individual fishery, as the contract for the booking is between the angler and the fishery, not the platform.

If an angler fails to attend, the booking is considered fulfilled and no refund, account credit, or rescheduling will be provided.

Where an angler does not make full use of the permit, the booking remains fulfilled with no entitlement to refund, account credit, rescheduling, or adjustment.

Variations in fishing conditions, including weather, water levels, or fish activity, do not entitle the angler to a refund, account credit, or rescheduling.

Unless a booking is formally cancelled by the fishery or the platform, no refund or account credit will be issued within 7 days of the scheduled fishing date.

Cooling-off Rights

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers normally have the right to cancel certain online purchases within 14 days.

However, this statutory cancellation right does not apply to bookings for leisure services provided on a specific date or within a specific period.

As fishing permits purchased through the platform relate to fishing on specified dates, the statutory 14-day cancellation right does not apply.

Chargebacks and Payment Disputes

By completing a booking, the user acknowledges that the purchase is made from the participating fishery.

Users should contact the platform or relevant fishery in the first instance to resolve any issue.

Unjustified or fraudulent chargebacks may result in account suspension or restriction.

The platform retains transaction records, confirmations, and activity logs which may be used as evidence.

Repeated or fraudulent disputes may result in permanent exclusion from the platform.

Liability

Fishing Around acts solely as a facilitator of transactions between anglers and fisheries.

The platform does not provide fishing services and does not control fishery operations.

To the fullest extent permitted by law, Fishing Around shall not be liable for:

  • fishing conditions

  • weather or water levels

  • fish stocks or catch success

  • access issues outside the platform’s control

  • fishery management decisions

  • acts or omissions of fisheries or anglers

The fishery is solely responsible for the delivery of the fishing experience, including access and safety.

Anglers access fisheries at their own risk.

Acceptable Use

Users agree not to:

  • misuse the platform

  • attempt to access restricted areas

  • provide false information

  • disrupt platform operation

  • use the platform for unlawful purposes

Intellectual Property

Platform content and branding are protected by intellectual property rights.

Users may not reproduce or distribute platform content without permission.

Privacy

User data is handled in accordance with the Fishing Around Privacy Policy.

Force Majeure

Fishing Around shall not be liable for delays or failures caused by events beyond its reasonable control.

Such events may include severe weather, natural disasters, telecommunications failures, internet outages, payment processor outages, cyber incidents, government action, or other events beyond reasonable control.

Changes to Terms

These Terms may be updated from time to time.

Updated Terms take effect from the date published on the platform unless otherwise stated.

Continued use of the platform constitutes acceptance of any updated Terms.

Entire Agreement

These Terms constitute the entire agreement between Fishing Around and the user regarding use of the platform.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in effect.

No Waiver

Failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other right.

Assignment

Fishing Around may assign or transfer its rights and obligations in connection with the operation of the platform.

Governing Law

These Terms are governed by the laws of Scotland.
